The prosecution advanced an argument, one that it consistently made throughout the trial, that: “a machine gun is any weapon that shoots more than one shot without manual reloading by a single function of the trigger.” whether Olofson’s AR-15 shot more than one shot at the single pull of the trigger as a result of a “hammer follow” malfunction “makes no difference under the statute: If you pull the trigger of a firearm once and it fires more than one round, no matter what the cause, it’s a machine gun.”
David Olofson, who is now in jail for 2 1/2 years, let his friend borrow the gun who took it to the range where it misfired. Olofson's friend was paid by the government to testify against him.
The details of this case are even worse, the way the investigation was done for one thing. The people who call themselves "government" went to great lengths to put this innocent man in a cage for years. His 3 kids will lose their father for 2 1/2 years, an eternity to a child. They will probably cage him in a far away state.
Only psychopaths would do this to another person. It is so blatantly obvious. Sure, you can interpret the horribly written law to its letter, but why should that trump everything? The prosecutor could have simply chosen to not charge him. The prosecutor is obviously a psychopath. Many prosecutors are, I would be willing to bet that most of them are.
The people in the jury could have used their common sense if they had any and chosen to not convict him. But sadly, most people in this country think the law trumps everything, even the most obvious travesty of justice.
